New Zealand
Following Earthquakes in New Zealand in recent years, Martyn Belben's expert witness services were retained to file a brief and to testify in the High Court in Christchurch, New Zealand. Martyn testified as to international practices and procedures in applying technical remedies to disputed issues but which involved traditional, and universally accepted policy language interpretation, claims practices, and procedures. Martyn also testified as to the methodology of computing complex loss adjustments, where there was confusion and misunderstandings perticularly when losses exceeded the limits of policy coverage; and also when Deductibles/Excesses were applied; and when, and under what circumstances, they were not applied, the latter being a major, misunderstood factor by the Court.
